END-USER LICENCE AGREEMENT FOR PSA SOFTWARE

IMPORTANT READ CAREFULLY:
This End-User Licence Agreement ('EULA') is a legal agreement between you the purchaser (either as an individual or representing a single entity) and PSA Data Solutions ('PSA') for the software product identified above, which includes computer software and may include associated media, printed materials. By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms and conditions (stated or otherwise implied) in this EULA. If you do not agree to this EULA, do not install or use this SOFTWARE PRODUCT.

While every effort has been made to ensure this SOFTWARE PRODUCT is functional, PSA can not be held responsible for:

1) the equipment being used.
2) the operating system being used.
3) failure of the person using the SOFTWARE PRODUCT to ensure that the operating system software, application software, and any other software required (such as upgrades, service releases and patches, drivers, etc) is current and meets the requirements of the SOFTWARE PRODUCT.
4) failure of the person using the SOFTWARE PRODUCT to ensure that there are no viruses.
5) failure of the person using the SOFTWARE PRODUCT to ensure that adequate and regular backup of data is performed in case of system failure.

IT IS YOUR RESPONSIBILITY TO MAINTAIN COMPUTER SYSTEM SOFTWARE AND HARDWARE AND ENSURE REGULAR DATA BACKUP IN CASE OF SYSTEM FAILURE

SOFTWARE PRODUCT LICENSE
The SOFTWARE PRODUCT is licenced, not sold.
The SOFTWARE PRODUCT is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

1) GRANT OF LICENSE. Grant of Licence is given on acceptance of the following terms and conditions.

·a) SOFTWARE PRODUCT. You may install and use the SOFTWARE PRODUCT on a computer. You may distribute this SOFTWARE PRODUCT to others, provided all associated metarials (including this EULA) are included.

·b) Storage/Backup. You may also store or install a copy of the SOFTWARE PRODUCT on a storage/backup device.

·c) Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the SOFTWARE PRODUCT.

·d) Rental. You may not rent or lease the SOFTWARE PRODUCT.

·e) Not for Resale Software. The SOFTWARE PRODUCT is "Not for Resale" and, notwithstanding other sections of this EULA, you may not resell, or otherwise transfer for value, the SOFTWARE PRODUCT.

·f) Customisation and Modification. This licence authorises the user of the SOFTWARE PRODUCT to use the SOFTWARE PRODUCT as a single package. Any modifications are done at the discretion of PSA.

·g) Warranty: This SOFTWARE PRODUCT is designed to be used as a part of MS Access. PSA does not provide a warranty, or guarantee, for any failure of the SOFTWARE PRODUCT, MS Access, the operating system, associated or other software, or the hardware, through the use of the SOFTWARE PRODUCT.

·h) Termination. Without prejudice to any other rights, PSA may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the SOFTWARE PRODUCT and all of its component parts.

2) COPYRIGHT. All title and copyrights in and to the SOFTWARE PRODUCT
(including but not limited to any images, photographs, animations, video, audio, music, text,
and 'applets' incorporated into the SOFTWARE PRODUCT), the accompanying printed materials, and any copies of the SOFTWARE PRODUCT are owned by PSA. The SOFTWARE PRODUCT is protected by copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE PRODUCT like any other copyrighted material except that you may copy the SOFTWARE PRODUCT, and the printed materials accompanying the SOFTWARE PRODUCT for the purpose of distributing to others.

3) INTELLECTUAL PROPERTY. This SOFTWARE PRODUCT remains the property of PSA. PSA grants the holder of the licence (either as an individual or representing a single entity) the right to use the SOFTWARE PRODUCT in accordance with the above terms and conditions.

4) FREEWARE PRODUCT: While this SOFTWARE PRODUCT is designated as a freeware product and may be feely distributed and used, PSA retains all rights to the SOFTWARE PRODUCT. Grant of the Licence is not conditional on payment of the Licence Fee.

5) PRODUCT SUPPORT: this product is free to use and therefore support is provided at the discretion of PSA.

6) LOSS OF DATA. PSA can not be held responsible for any data lost through the use of the SOFTWARE PRODUCT. The user accepts all liabilities and costs incurred through loss of data and/or incorrect data being used by the user, or distributed to others.
